1. Last updated and scope
These Terms and Conditions govern access to Instatyre, the tyre catalogue, search tools, account features, carts, checkout, support, order tracking, reviews, returns, warranty requests and any related storefront services. By using the site or submitting an order, the customer agrees to the version of these terms posted at the time of use, subject to mandatory consumer rights.
2. Policy set incorporated
The Privacy and GDPR Policy, Cookie Policy, Return and Refund Policy, Shipping Policy, Warranty Policy and Payment Methods page form part of the Instatyre policy set. Customers should review those policies before placing an order because they explain data use, cookies, payment status, delivery, cancellation, return and after-sale support.
3. Eligibility and account use
The storefront is intended for customers who can legally purchase products in their location and provide accurate account, contact, billing, delivery and vehicle or tyre-size information. Customers are responsible for account security, password confidentiality, authorized account users and promptly notifying support of suspected unauthorized access.
4. Accurate information
Customers must provide complete and current name, email, phone number, billing address, delivery address, postcode or CAP, order details and any fitment information used to search or buy tyres. Instatyre may delay, refuse, suspend or cancel an order if information is incomplete, inaccurate, suspicious, outdated or prevents lawful service.
5. Site access and permitted use
Instatyre grants customers a limited, personal, non-exclusive and non-transferable right to use the storefront for legitimate shopping, account, order, support and informational purposes. Customers may not copy, scrape, frame, reverse engineer, overload, interfere with, attack, harvest data from or commercially exploit the site except where expressly permitted.
6. Security restrictions
Customers must not create accounts under false pretences, use automated tools to abuse search or checkout, transmit malware, attempt to bypass security, test payment endpoints without authorization, collect other users data, interfere with availability, send spam, manipulate reviews, or use the site in a way that violates law or third-party rights.
7. Product information
Product pages may show tyre size, load index, speed rating, EU label values, DOT or year notes, stock, warranty indicators, rim-protection notes, XL, run-flat, EV, season and class markers. Images identify product family and presentation, but exact sidewall, tread detail, label, DOT or packaging may vary by size, batch, manufacturer update and stock location.
8. Fitment responsibility
Customers must verify the current tyre sidewall, vehicle handbook, registration document, manufacturer requirements and local rules before ordering. Compatibility may depend on homologation, axle load, speed rating, rim diameter and width, TPMS, run-flat systems, EV weight, wheel offset, brake clearance, suspension changes, winter rules and vehicle modifications.
9. Tools and advice
Size decoders, vehicle helpers, EU label explainers, tread-depth notes, comparison tools and chat or support prompts are provided to reduce uncertainty. They are not a substitute for inspection by a qualified tyre professional where the vehicle has modified equipment, aftermarket wheels, unclear documentation, uneven wear, damage or safety concerns.
10. Prices, taxes and displayed totals
Prices are shown in euros unless another reference currency is displayed. Checkout should show tyre price, quantity, VAT or tax estimate where applicable, delivery notes, selected add-ons and the final amount before payment authorization. If a price, stock or specification error is obvious, material or caused by manifest failure, Instatyre may cancel and refund the affected order.
11. Order process and acceptance
Adding products to the cart or submitting checkout does not guarantee acceptance. An order is accepted only after payment authorization, stock validation, fraud and security review where applicable, address review and dispatch preparation. Instatyre may refuse or cancel orders affected by payment failure, suspicious activity, stock errors, delivery restrictions, incorrect customer data or legal restrictions.
12. Payment rules
Available payment options are displayed at checkout. Customers must confirm the final amount before payment. Card data must be entered only through the secure payment provider flow; Instatyre does not ask customers to send card numbers, CVV codes, passwords or payment credentials through email, chat, contact forms or support tickets.
13. Stock, substitutions and delivery
Stock indicators are informational and can change before dispatch. If products become unavailable after checkout, support may offer a substitute, delayed dispatch, partial cancellation or refund. A substitute tyre is not dispatched unless the customer accepts the substitute and any changed price, label, size, brand or delivery term where required by law. Delivery estimates are not guaranteed dates unless expressly stated.
14. Cancellation, faults and misuse
Consumers may have statutory distance-selling cancellation and withdrawal rights. Customers should report damaged, faulty, missing or incorrect goods promptly with photos, packaging details, order reference and product condition. Instatyre is not responsible for issues caused by incorrect size selection, inaccurate vehicle data, misuse, underinflation, overloading, impact damage, racing or track use, poor alignment, suspension defects or unauthorized repair.
15. Reviews and user content
Customers may submit reviews, comments, images, support material or other content where the site allows it. Customers retain ownership of their content but grant Instatyre a worldwide, royalty-free right to host, display, reproduce, adapt, moderate and use that content for store, support, quality, fraud-prevention and marketing purposes, subject to privacy law and customer rights. Content must be truthful, lawful and relevant.
16. Intellectual property and trademarks
The site design, text, software, product presentation, images, video, data arrangement, guides and tools are owned by Instatyre, its licensors or relevant rights holders. Manufacturer names, marks and product identifiers are used only to identify products offered for sale. Instatyre is an independent retailer and is not affiliated with, sponsored by or endorsed by any manufacturer unless expressly stated.
17. Third-party services and availability
The storefront may use Shopify checkout, payment providers, hosting providers, analytics, maps, video, chat, review tools, couriers, installers, manufacturers or support systems. Third-party services may have their own terms and privacy notices. Maintenance, hosting incidents, payment-provider downtime, courier integrations, security events, network failures or force majeure events may interrupt search, cart, checkout, support or order tracking.
18. Mandatory rights, law and complaints
Nothing in these terms excludes liability that cannot legally be excluded, including mandatory consumer remedies. To the extent permitted by law, Instatyre is not liable for indirect loss, loss caused by customer misuse, unavailable third-party services, incorrect customer information, or business losses from consumer-only use of the site. These Terms of Service and any separate agreements whereby we provide services shall be governed by and construed in accordance with the laws of Hong Kong.
